1 INTRODUCTION TO THIS PRIVACY POLICY
1.1 Ebizmedic takes the privacy of all individuals who interact on Ebizmedic seriously. Ebizmedic is  committed to properly managing, processing and protecting your Personal Data in accordance with this Privacy Policy (“Policy”) and all applicable laws, regulations and guidelines including but not limited to the Data Protection Act 2010 of Malaysia (“PDPA”), which shall apply to all Personal Data we collect from you through our Platform.
1.2 The information collected from you will be kept confidential at all times, unless specified otherwise in this Policy. In order to protect your Personal Data, we have established this Policy which describes how we handle your personal data when using our services on our Platform and all of its related sites, services and tools.
1.3 By accepting the “Privacy Policy”, “Terms of Service (Vendors)” and/or “Terms of Use” during your registration and/or ordering any of our products and services, you are deemed to have given express consent to our collection, storage, usage and disclosure of your Personal Data in accordance with the manner as set out in this Policy. If you do not agree with this Policy or any amendments to this Policy, please do not access our Platform or use our services.
   
2 DEFINITIONS
2.1 Applicable Laws” means Malaysia’s Personal Data Protection Act 2010 and its subsidiary legislations and regulations as amended from time to time.
2.2 Buyer” means a third-party, who purchases Product on the Platform.
2.3 Ebizmedic, we, us, our, or the Company” means Ebizmedic Sdn Bhd and its affiliates.
2.4 Personal Data” means any data, whether true or not, which is (a) about an individual who can be identified (i) from that data; or (ii) from that data and other information to which we have or are likely to have access and would include data in our records as may be updated from time to time, or (b) defined as “personal data” or “personal information” under any applicable Data Protection Laws which shall include but not limited to name, contact details, mailing and delivery address, email address, birthday, network and device data, shopping and browsing behaviours, facial image, voice recording (for customer service calls) and any other personally identifiable information which you have provided us in any forms you may have submitted to us, or in the course of any other forms of interaction between you and us. If you provide us with Personal Data relating to a third party by submitting such Personal Data to us, you represent to us that you have obtained the consent of the third party to provide us with their Personal Data for the respective purposes.
2.5 Platform” means the Ebizmedic platform on the website of https://www.ebizmedic.com and any mobile application if made vailable on mobile operating systems (including on iOS and Android), where Vendor may list Products for sale under these Terms, and where Buyer(s) may buy such Products.
2.6 Product: means one (1), or several good(s) or service(s) (as the case may be) offered for sale by Vendors to Buyers on the Platform.
2.7 Vendors” means the sellers listing products for sale on the Platform.
   
3 SCOPE
3.1 By (1) clicking “Yes” on our Policy pop-up or any web form referring to this Policy on any of our Platform, (2) submitting your Personal Data to us when signing up/registering for an account on the Platform, (3) browsing our Platform, or (4) ordering any of the Products, you are agreeing to the terms of this Policy.
3.2 We will update this Privacy Policy from time to time if warranted, in response to changing legal, regulatory or operational requirements. We will provide notice of any such changes on our Platform. We also reserve the right to modify, update and/or amend this Privacy Policy at any time.
   
4 PERSONAL DATA COLLECTION
4.1 You may visit the Platform at any time without providing your identity or revealing any personal information about yourself. However, we and/or the Vendors may collect and store your computer and connection information, statistics on page views, traffic to and from the Platform, ad data, IP address and standard web log information and information from other companies, such as demographic and navigation data. 
4.2 We and/or the Vendors collect Personal Data from you when:

  1. You register an account on the Platform;
  2. You use any of our related services, such as subscribing to our newsletter, product notifications;
  3. You browse our products and services or otherwise interact with our Platform;
  4. You accept our cookies on your device;
  5. You interact with our customer experience team or other representatives, for example, via our webform, emails, telephone calls, letters, or face-to-face meetings;
  6. You interact with us on our social media, such as liking our posts, commenting on our posts, private messaging us on our social media;
  7. You participate in our promotions, lucky draws, initiatives or any request for additional Personal Data such as customer surveys;
  8. We receive references from business partners and third parties, for example, where they referred you to us to enjoy the benefits of a joint promotion or collaboration or to redeem a voucher you purchased through them;
  9. Your authorized representative submits your Personal Data to us for any purpose reasonably authorized by you, for example if such representative is purchasing our product or service to be delivered to you or as a gift;
  10. Our third-party analytics and other service providers provide your Personal Data to us, which was collected and processed by them and disclosed to us pursuant to their separate privacy policies; or
  11. When you voluntarily submit your Personal Data to us for any reason.
4.3 In connection with your registration and use of the Platform, we and/or the Vendors may collect and store the following personal data:

  1. email address, physical contact information, the date of birth and gender information, and /or financial information, such as credit card or bank account numbers etc;
  2. transactional information based on your activities on the Platform;
  3. postage, billing and other information you provide to purchase or dispatch an item;
  4. community discussions, chats, dispute resolution, correspondence through our Platform, and correspondence sent to us;
  5. other information from your interaction with the Platform, services, content and advertising, including computer and connection information, statistics on page views, traffic to and from the Platform, ad data, IP address and standard web log information;
  6. additional information we ask you to submit to authenticate yourself or if we believe you are violating site policies (for example, we may ask you to send us an ID or bill to verify your address, or to answer additional questions online to help verify your identity or ownership of an item you list);
  7. information from other companies, such as demographic and navigation data;
  8. other supplemental information from third parties (for example, if you incur a debt to us, we will generally conduct a credit check by obtaining additional information about you from a credit bureau, as permitted by law).
4.4 All personal data shall be provided by you voluntarily unless it is indicated as mandatory. Where the personal data is mandatory to be provided, failure to provide such information may result in Ebizmedic and/or the Vendors not being able to provide you with any services. If you provide us and/or the Vendors with Personal Data relating to a third party by submitting such Personal Data to us and/or the Vendors, you represent to us and/or the Vendors that you have obtained the consent of the third party to provide us and/or the Vendors with their Personal Data for the respective purposes.
   
5 USE OF DATA
5.1 Ebizmedic and/or the Vendors’ primary purpose when collecting personal information is to provide you with a safe, smooth, efficient and customized experience. The acceptance of this Privacy Policy allows us and/or the Vendors to:

  1. register and maintain your user account and to verify your identity or age;
  2. process your order for the Products, process or collect your payment for the order;
  3. deliver the Products you purchased, including our couriers calling or messaging you to obtain your delivery instructions;
  4. process your returns or refunds in accordance with our Return, Replacement and Failed Delivery Policy;
  5. provide you with supporting services and functions related to your user account, such as saved items in cart, wish list, brand or product notifications;
  6. communicate with you in relation to (i) your queries, requests and feedback, (ii) material changes to our Platform’s Terms of Service (Vendors), Terms of Use, policies or other terms and conditions, and (iii) matters relating to the operation of your account;
  7. personalise and improve your customer experience when you visit the Platform, for example by prioritizing products and services appearing in your search results or feed;
  8. monitor and enforce compliance with our Terms of Service (Vendors), Terms of Use, including dispute resolution;
  9. comply with (i) internal risk controls, (ii) the terms of our access to payment processing, financial or banking services such as credit card disputes, fraud, billing errors, or (iii) any applicable law;
  10. Provide the appropriate service and customer support for you; and
  11. ensure the Platform function properly and to improve their performance, by carrying out activities such as debugging, statistical analyses for optimizing our Platform.

6 MARKETIINIG
6.1 Ebizmedic does not sell, rent, transfer or disclose any of your Personal Data to third parties without your explicit consent. However, we may combine your personal data with information we collect from other companies for the purposes of improving and personalising our services, content and advertising.
6.2 If you do not wish to receive marketing communication from us and/or the Vendors or participate in our ad-customization programs, simply unsubscribe from such marketing material as provided with the communication or advertisement.
   
7 VIEWING AND DOWNLOADING CONTENT
  During the browsing of the Platform, when you watch content and advertising and when you access other software on the Platform, most of the same information are sent to us (including, without limitation, IP Address, operating system, etc.); but, instead of page views, your computer sends us information on the content, advertisement viewed and/or software installed by the services and the Platform and time.

DENIAL OF COLLECTION/WITHDRAWAL OF CONSENT

  You may withdraw your consent to our and/or Vendors’ collection of your Personal Data and/or information at any time by notifying us or by calling our customer service. In that event, we will not be able to identify you and provide you with a safe, smooth, efficient and customized experience while using the Platform. Although you can browse through most of our Platforms without giving any information about yourself, in some cases, personal information is required in order to provide the services you request.
   
9 DISCLOSURE OF INFORMATION AND DATA
9.1 In relation to our and/or the Vendors’ use of your Personal Data for the Purposes or Additional Purposes, we and/or the Vendors may disclose your Personal Data, within and outside Malaysia, to:In relation to our and/or the Vendors’ use of your Personal Data for the Purposes or Additional Purposes, we and/or the Vendors may disclose your Personal Data, within and outside Malaysia, to:

  1. Our employees, consultants, temporary workers;
  2. The Vendors, who supply and deliver the products or services you ordered through the Platform;
  3. Third-party service providers under contract who help with our business operations: We employ other companies and individuals to perform functions on our behalf. Examples include fulfilling orders, delivering packages, sending postal mail and e-mails, removing repetitive information from customer lists, analyzing data, providing marketing assistance, providing search results and links (including paid listings and links), processing credit card payments, investigating fraud and providing customer service. They have access to personal information needed to perform their functions but may not use it for other purposes.
  4. Third parties giving promotional offers.
  5. Other third parties to whom you explicitly ask us to send your information to (or about whom you are otherwise explicitly notified and consent to when using a specific service).
  6. Financial institutions or any party processing payment.
  7. Law enforcement or other governmental officials, in response to a verified request relating to a criminal investigation or alleged illegal activity. In such events, we will disclose information relevant to the investigation, such as name, city, postal code, telephone number, email address, User ID history, IP address, fraud complaints, and purchasing and listing history.
  8. Other business entities, should we plan to merge with or be acquired by that business entity. (Should such a combination occur, we will require that the new combined entity follow this Policy with respect to your personal information. If your personal information will be used contrary to this policy, you will receive prior notice)
  9. business partners who separately maintain an account with you for loyalty or point redemption programs;
  10. business partners or Vendors in connection with the processing of any promotion, event or service organised by us;
  11. professional advisers and consultants;
  12. agents, contractors or service providers who provide operational services to us, such as online cloud storage and processing, marketing optimization, information technology, telecommunications, security or other relevant services which requires their collection, use or disclosure of your Personal Data; and
  13. any other party whom you authorize us to disclose your Personal Data to.
9.2 We and/or the Vendors may disclose your personal information to respond to any legal requirements, the enforcement of our policies, responding to claims that a listing or other content violates the rights of others, or protect anyone’s rights, property, or safety. Such information will be disclosed in accordance with Applicable Laws and regulations.
9.3 We and/or the Vendors may also share your personal information with third parties assisting our business operations under contract, including but not limited to fraud investigations and debt collection, with law enforcement or other governmental officials if required by law, and with other business entities, should we plan to merge with or be acquired by that business entity. We require all such third parties to treat your personal information as fully confidential and to fully comply with all applicable Malaysia personal data protection and consumer legislation from time to time.
9.4 Without limiting the above, in an effort to respect your privacy and our ability to keep the community free from bad actors, we will not otherwise disclose your personal information to law enforcement, other government officials, or other third parties without a subpoena, court order or substantially similar legal procedure, except when we believe in good faith that the disclosure of information is necessary to prevent imminent physical harm or financial loss or to report suspected illegal activity.
9.5 For the avoidance of doubt, if we have reasonable grounds to believe that any user is in breach of any of the terms of this Privacy Policy, we reserve the right, in its sole and absolute discretion, to cooperate fully with governmental authorities, private investigators, all the rightful owner(s) or interest holder(s) and/or injured third parties in the investigation of any potential or ongoing criminal or civil wrongdoing. Further, we may disclose the user’s identity and contact information, or such other transaction-related data, if requested by a government or law enforcement body, private investigator, rightful owner or interest holder and/or any injured third party or as a result of a subpoena or other legal action, or if we are of the view, in its sole and absolute discretion, that it would be in its best interest to do so. We shall not be liable for any damages or results arising from such disclosure, and you agree not to bring an action or claim against us for such disclosure.
   
10 USING OF INFORMATIION FROM PLATFORM
10.1 We enable you to share personal information to complete transactions. When users are involved in a transaction, they may have access to each other’s name, user ID, email address and other contact and postage information. In all cases, you must comply with data protection laws, and give other users a chance to remove themselves from your database and a chance to review what information you have collected about them.We enable you to share personal information to complete transactions.   • using services offered through this Platform;

11 COOKIES
11.1 We use "Cookies" (a piece of data stored on a user’s computer that is tied to information about the user) on some of our pages to help improve our services. Cookies help analyse our web page flow; customize our services, content and advertising; measure promotional effectiveness, and promote trust and safety when using our Platform.
11.2 A few important things you should know about Cookies are:

  • We offer certain features that are available only through the use of Cookies;
  • We use Cookies to help identify you and maintain your signed-in status;
  • Most cookies are "session cookies," meaning that they are automatically deleted from your hard drive at the end of a session;
  • You may encounter cookies from third parties on certain pages of the Platform that we do not control (For example, if you view a web page created by another user, there may be a cookie placed by that web page).
11.3 Users are free to disable cookies on their browsers before using the Platform. However, there may be drawbacks such as certain features of the Platform not being able to function properly without the aid of cookies.
11.4 We use the services of third party vendors, who may implement cookies on the Platform. Advertisements on the Platform may be provided by third party agencies. These advertisements may also generate cookies, for example, to track how many people have viewed the advertisement.  The collection, use, and disclosure of information, including Personal Data, collected by such third party cookies are subject to the privacy and data protections policies of the third party vendors and are not under our control. You may reject third party cookies through the settings on your browser. Note that this may result in the loss of Platform functionality, restrict your use of the Platform, or delay or affect the way in which the Platform operates.
   
12 ACCOUNT PROTECTION
12.1 Your password is the key to your account. Please choose an account password that would be difficult for others to guess. Use unique numbers and letters and do not disclose your password to anyone else. If you do share your password or your personal information with others, please remember that you are responsible for all actions taken in the name of your account. Should you lose your password, you may lose substantial control over your personal information and may be subject to legally binding actions taken on your behalf. Therefore, if your password has been compromised for any reason, you should immediately notify us and change your password.
12.2 We will never ask for your password by phone or e-mail.  If you receive such an inquiry, please report the incident to our customer service support.
12.3 If you access our Platform from a shared computer or a computer in an internet cafe, a PC room or a library, certain information about you, such as your user ID, activity or reminders from the Platform, may also be visible to other individuals who may access the computer after you. To protect your personal information or communication from being disclosed to others, do log out and close the web browser after using our Platform.
   
13 CHANGING OF PERSONAL DATA
13.1 You can review and change most of your personal information by signing onto the Platform. Generally, we will not manually modify your personal information because it is very difficult to verify your identity remotely. You must promptly update your personal information if it changes or becomes inaccurate. Once you make a public posting, you may not be able to change or remove it. Upon your request to the customer service, we will close your account and remove your personal information from view as soon as reasonably possible, based on your account activity and in accordance with applicable law. We do retain personal information from closed accounts to comply with law, prevent fraud, collect any fees owed, resolve disputes, troubleshoot problems, assist with any investigations, enforce our Term of USe, and take other actions otherwise permitted by law. Otherwise, your personal information will be destroyed by us once we confirm there is no use for it.
13.2 We will make reasonable efforts to ensure Personal Data likely to be used by us or disclosed by us to another organization is accurate and complete. However, you should update us of any changes in your Personal Data. We will not be responsible for relying on inaccurate or incomplete Personal Data if you have not updated us of changes.
13.3 We will also put in place reasonable security arrangements to ensure that your Personal Data is adequately protected and secured. This includes putting in place reasonable measures to prevent any unauthorized access, collection, use, disclosure, copying, modification, leakage, loss, damage or alteration of your Personal Data. However, we will not be responsible for any unauthorized use of Personal Data by third parties which is attributable to factors beyond our control.
13.4 If Personal Data is transferred out of Malaysia, we will comply with Applicable Laws in doing so. This includes: (i) obtaining your consent, unless an exception exists under Applicable Laws or any other laws, and (ii) taking reasonable steps to ascertain whether the foreign recipient of the Personal Data is bound to comply with standards of protection that are at least comparable to the Applicable Laws.
   
14 CHILDREN’S INFORMATION AND PRIVACY
  We do not direct any of our content specifically to children. Users of our Platform are required to be at least 18 years old, and any user under 18 is not an authorized user. We will close down any accounts used exclusively by such children and will remove and/or delete any personal data we believe was submitted by any child under the age of 18.
   
15 SECURITY MEASURES
15.1 Your information is stored on our servers located in Malaysia. We treat data as an asset that must be protected and utilise tools (encryption, passwords, physical security, etc.) to protect your personal data against any unauthorized access and/or disclosure.
15.2 However, there is still a probability of third parties unlawfully intercepting or gaining access to transmissions or private communication. There is also the possibility of other users abusing or misusing your personal data that they collect from the Platform. Therefore, although we work very hard to protect your privacy, we cannot and do not promise that your personal information or private communication will always remain private.
   
16 THIRD PARTIES
16.1 Except as otherwise expressly included in this Privacy Policy, this document addresses only the use and disclosure of information we collect from you. If you disclose your information to others, whether they are buyers or vendors on our Platform or other sites throughout the Internet, different rules may apply to their use or disclosure of the information you disclose to them. We do not control the privacy policies of third parties, and you are subject to the privacy policies of those third parties where applicable. We encourage you to ask questions and to review their privacy policies before you disclose your personal information to others.
16.2 We, and third parties, may from time to time make software applications downloads available for your use. These applications may separately access, and allow a third party to view, your identifiable information, such as your name, your user ID, your computer’s IP Address or other information such as any cookies that you may previously have installed or that were installed for you by a third-party software application or Platform. Additionally, these applications may ask you to provide additional information directly to third parties. Third party products or services provided through these applications are not owned or controlled by us. You are encouraged to read the terms and other policies published by such third parties on their Platforms or otherwise.
   
17 UPDATES ON DATA PROTECTION POLICY
 

As part of our efforts to ensure that we properly manage, protect and process your Personal Data, we will be reviewing our policies, procedures and processes from time to time. In this regard, we may update this Privacy Policy to ensure that it is consistent with industry trends and any changes in legal or regulatory requirements. We reserve the right to amend the terms of this Privacy Policy at our absolute discretion.

Subject to your rights at law, you agree to be bound by the prevailing terms of this Privacy Policy as updated from time to time on our Platform. Any amended Policy will be posted on our Platform. By continuing to use our Platform and/or services after the Policy has been amended, you hereby agree to be bound by the terms of such amended Policy.

18 GOVERNING LAWS
  This Privacy Policy and your use of this Platform shall be governed in all respects by the laws of Malaysia.
   
19 LANGUAGE OF POLICY
  In accordance with the requirements of the laws of Malaysia, this Privacy Policy is issued in both English and Bahasa Malaysia. In the event of any inconsistencies or discrepancies between the English version and the Bahasa Malaysia version, the English version shall prevail.
